Medical Injuries and Malpractice

With all the cases of medical malpractice that occur, there are only a few claims filed. A New England Journal of Medicine article found that only 2% of people that are injured by medical malpractice seeks compensation through a lawsuit. Don't be a victim. When a patient dies or sustains injury due to negligent medical care, the physician, hospital or other health care provider may be held liable under California’s medical malpractice laws. In order to prove a medical malpractice lawsuit it must be shown that:

The health care provider responsible for the medical treatment deviated from the accepted standard of care in his or her field of medicine; and The health care provider's negligence was a substantial factor in causing the patient's injuries or death.
