A Rocklin Cosmetic Surgeon, Dr. Efrain Gonzalez, has been sentenced to 3 months of house arrest.
Dr. Gonzalez, a former Rocklin Plastic Surgeon, could also face civil charges of medical malpractice if former patients decide to file a claim in Rocklin, CA courts.
As part of Efrain’s no contest plea deal, he was ordered to pay $100,000 into a victim compensation fund for those patients that decide not to file a Medical Malpractice Lawsuit in Rocklin. The charges filed against him were for tax evasion and performing medicine without a license. Gonzalez will be required to wear an ankle bracelet as part of his sentence.
Additionally charges against Dr. Yessennia Candeleria were dismissed in a plea deal that sentences her to 7 years of probation. The month prior to the sentencing her medical license was revoked but the judge ordered a stay in this action which allows her to continue to practice with oversights by the CA Medical Board.
A number of medical malpractice suits are currently pending in Rocklin now that the criminal charge of Mayhem has been removed for the case. Because of this ruling the path to malpractice payoff is greater for the victims now that these lawsuit can be tried in civil courts.
A prominent Sacramento plastic surgeon, Dr Zimmerman, who helped a large number of these victims with corrective surgeries stated he that the former patients of Gonzalez could have not suffered a greater injustice. Dr. Zimmerman believes that the charges should be criminal and not medical malpractice.
If not for the plea deal, Dr. Candelaria could have faced felony criminal charges for performing anesthesia to Dr. Gonzalez’s medical malpractice victims. She will also be required to take frequent drug tests, complete a medical ethics course and be treated by a psychologist.
